"官煤勾结"背后的经济分析及法律思考

近年来,各地频频发生的煤矿事故,给人民的生命财产造成了极大的损失,也引起了社会的广泛关注.矿难事故频发,虽然非法开采、设备落后、意识淡薄、执法不力、罚不够狠是祸端.但从对事故深层次原因来分析,“官煤勾结”是造成很多矿难的一个主要原因.官员们之所以敢铤而走险,从经济学角度来看,是因为预期腐败带来的收入将要高于他甘冒风险所付出的成本;从法律角度来看,当前的法律对官员没有太大的约束力.因此,要从根本上消除“官煤勾结”现象,笔者认为,只有加大对“官煤勾结”的惩罚力度,提高勾结的成本,才能使这种现象无所遁形.

On the view of economy, the fact that the income out of the anticipatory corruption will be higher than the cost of his risk making much money. And in the point of the law, it is because the present law has loose restraints on the officials. In order to completely get rid of the phenomenon of the collusion between bureaucrats and coal businessmen, we should punish the related officials severely and increase the cost of the collusion.
