| 摘 要： | 目前，学术界频现科研幂诚信现象。对比“学术失范行为”“学术腐败”“学术不端行为”等概念，采用“科研不端行为”的说法更为贴切。我国对于科研不端行为的立法处于各部门规范遍地开花、规范不统一的局面，在借鉴羡国立法和实践经验的基础之上，我国有必要在《科学技术进步法》中对科研不端行为的定义、处罚措施作出明确规定，建立专门机构，加强诚信建设，并将一些严重科研不端行为列入刑法规制。

| Abstract: | Scientific misconduct is becoming a frequent phenomenon in our country,however,the legislation against it is lacking of uniformity and criterion.Therefore,by way of drawing on American legislative and practical experience,it is of necessity for us to unify its definition and punishments in Law of the People's Republic of China on Science and Technology Progress,and establish special department to enhance integrity construction.If necessary,some severe scientific misconducts should be subject to criminal law... |
