| 摘 要： | 我国目前尚无专门立法对见义勇为行为的认定和保护做出明确规定,国家对见义勇为者的补偿义务也处于法律缺失状态,致使见义勇为者难以获得有效的法律救济。完善我国见义勇为法律救济机制必须进行专门立法,准确界定见义勇为行为及其民事法律后果,明确国家补偿义务,完善见义勇为基金制度。

| Abstract: | Fighting against unjustice is one of the noble actions in human society as well as a traditional virtue.There is no special legislation on how to determine and protect the action against unjustice in China.Moreover there is a legal lack of state compensation duty for the brave people who fight against unjustice.As a result,it's hard for those brave people to acquire enough and effective legal remedies.Thus,it is necessary to make a special law so as to determine accurately the action against unjustice,the civil liability and the compensation duty of the state amd promote remedy funding system. |
