摘    要:在国家各项法律制度不断规范、劳动者维权意识不断增强的环境下,工作时间超过法律规定而产生的追索加班工资案件不断增加,给企业造成经济损失。要规避工作超时引起的法律风险,需合理运用工时管理制度,加强对加班事项的申报与审批,科学设置薪酬结构与设定加班工资支付标准,妥善处理调休与加班工资、值班与加班间的关系,强化证据保管意识。

Abstract:The more formal the states legal systems are and the stronger the laborers' right--protection awareness is, the more frequently the labor disputes occur in pressing for overtime wage. In order to avoid legal risk caused by overtime work, it is necessary to properly use man--hour management system, strengthen reporting and examination of overtime proceeding, set salary structure and overtime payment standard in a scientific way, better balance relations between paid leave and overtime pay and between duty hour and extra work, and take more care of the evidence.
