试论我国土地征用制度的改革方向

我国土地征用制度的改革方向应为:在法律层面明确区分"为了城市建设储备土地"的征用和"为了公共利益需要"的征用两种不同性质、不同目的的土地征用;必须强化国家(或城市政府)在土地征用过程中的主导作用,真正实现一级土地市场的政府垄断;以切实保障失地农民的应得利益和使城市政府具有支付能力为目标,建立多形式、多层次、多方法的征地补偿制度.

Discussion on the Direction of Reform of Land Requisition System in China

The direction of reform of land requisition system in China should be as follows: in legal as- pect distinction should be clearly made between land requisition for "land reserve for urban con- struction" and land requisition for "the needs of public interest", two kinds of land requisition of dif- ferent natures and purposes. The dominant role of the government should be strengthened in the course of land requisition so as to realize the goal of gov- ernmental monopoly over the primary land market, with guaranteeing the interest of the farmers who lose the land and the enabling the city government to have the ability to pay as the goal, thus establish- ing a compensation system for land requisition with multi-forms, at multi-layers and in multi-ways.
