关于垄断的形式及其行为认定

垄断是指企业或其他组织利用经济的或非经济的手段,在经济活动中对生产和市场实行排他性控制,从而限制、阻碍竞争的状态或行为。其主要认定原则有：(1)以合理原则为主,本身违法原则为辅；(2)以规制经济垄断为主,规制行政垄断为辅；(3)以维护市场竞争为原则,控制企业合并的规模。
