少数民族习惯法对国家法制现代化建设的作用

本文在否定法制现代化即用欧美国家法律制度全盘取代传统法律制度的同时,也指出了“国家法律至上”的理念绝对化的缺陷。在多民族国家应肯定少数民族习惯法对国家法制现代化的积极作用。在此基础上,文章进一步论述了少数民族习惯法与国家法的区别,揭示了国家法相对于少数民族习惯法所存在的跨地域性、跨民族性、概括性、超前性、高成本性以及难以有针对性地及时、有效解决少数民族地区的一些具体问题等特点。

The Effect of the unwritten Law in Minority Group on Modernization Construction of National Legal System

This article supports the idea that legal system in Europe and America Should take place of the traditional law completely.It negates the modernization of legal system.At the same time,it also points out the defects of the concept that constitutional Law is supreme is too absolute.We should affirm the positive effects of the unwritten law in minority groups on the modernization of national legal system in such a country where different groups co-exist.This article further explains groups and constitutional Law.It points out that comparing to unwritten law,constitutional law has the characteristics of transregion,transnationalism,generality,pre-mature,high-cost and so on.As a result,it can't solve some specific problems in minority groups effectively and timely.
