中美高校科技成果转化中的知识产权保护问题刍议

我国在高校科技成果转化中知识产权保护方面存在着科研人员保护意识不强;缺乏专业的知识产权管理队伍;技术交易价格偏低,缺乏合理的评估依据等问题。美国知识产权制度已有几百年历史,完善的知识产权保护制度为高校的科技创新提供了良好的外部条件。借鉴美国的一些做法,我国应在加强高校科技成果转化中的知识产权保护方面采取以下对策：以统一立法形式,突出发明人和科研人员的地位;成立知识产权与技术转移管理专门机构,培养专业管理队伍;营造高校知识产权保护环境,激励科研人员不断创新。

A Survey on IPR Protection in the Commercialization of High-Tech Outputs between Sino-US Higher Education Institutions

There are such problems in the IPR（intellectual property rights） protection of the commercialization of research outputs in the Chinese higher education institutions,as the weakness of awareness of protection,the want of professional management team of IPR,lower technical trading prices,and lack of a reasonable basis for assessment and so on.US intellectual property system enjoys a few hundred years of history and thus provides a good external condition for the college＇s science and technology innovation.With the American experiences in IPR as examples,we should strengthen the IPR protection in the commercialization of research outputs in our higher education institutions by adopting the following measures as to highlight the status of inventors and researchers through uniformed legislation,to establish specialized agencies in IPR management and technology transfer,to develop a professional managing team,to create an environment in universities for IPR protection to encourage researchers to innovate continuously,to promote their awareness of protection throughout the whole process of technology transfer.
