摘    要:为了维护劳动合同当事人,特别是维护在劳动关系中处于弱势地位的劳动者的利益,在劳动合同立法中要坚持无固定期限劳动合同为主,有固定期限合同为辅的原则,突出无固定期限劳动合同的地位,承认口头劳动合同的法律效力,在劳动者预告解除劳动合同权利的期限上要根据劳动者的不同身份和地位,分别作出不同期限的规定,同时应将无条件的预告解除权平等地授予用人单位。

Abstract:In order to maintain the benefit to the labor contract litigant,especially for the disadvantaged people,the labor contract legislation must focus on unfixed deadline labor contract and the fixed deadline contract as the auxiliary,putting the unfixed deadline labor contract the main position,acknowledging oral labor contract the legal effectiveness.The deadline to dismiss the labor contract litigant should according to laborer's different status,separately make the different deadline,simultaneously the unconditional notification should inform the employer.
