| 摘 要： | 合伙属于什么性质的法律主体,学者对此存在不同的主张。在社会主义市场经济中,合伙应该属于非法人团体,是一种有别于公民和法人的独立的民事主体;相应地,在民事诉讼法律关系中,合伙也必然获得独立的民事诉讼主体资格。

| Abstract: | Legal scholars have different viewpoints on "partnership".In the socialist market economy,the partnership shoule belong to unincorporated association,which has independent civil subject different from civil and legal entity.Accordingly,it should gain an independent procedure subject qualification in the civil proceedings legal relation. |
