论汉代婚姻礼法的伦理教化功能

自汉武帝“罢黜百家,独尊儒术”始,推动法律儒家化进程,对儒家伦理进行推广和贯彻便成为封建统治集团法制建设的中心。在这一过程中,以调整婚姻家庭关系为核心的婚姻礼法率先承担起传承儒家伦理的重任,从缔结婚姻的形式要件到实质要件都严格贯彻儒家伦理道德,最终为儒家化的封建法律秩序的构建做出了重要贡献。因而对儒家伦理进行宣传和推广、对违反儒家伦理的行为进行惩治的伦理教化功能可以说是汉代婚姻礼法的主要功能追求。

On Ethical Culture Function in Marriage Ritual Law of Han Dynasty

Since Emperor Wu of Han Dynasty ＂rejecting all kinds of theoretical schools but Confucianism＂,it had been the legal construction center by feudal ruling groups to popularize and implement Confucian ethics.During the process,marriage ritual law whose core was to adjust married family relations took the task of inheriting Confucian ethics,strictly implementing the essentials of marriage formation and essence of the marriage,making important contribution to the buildup of feudal legal order on the basis of Confucianism.Therefore,it can be said that the major ethical functional pursuit by marriage ritual law of Han Dynasty is to popularize Confucian ethics and to punish the behavior against Confucian ethics.
