| 摘 要： | 我国的证人制度规定:自然人、单位都可以出庭作证.但从证人的自然本性、国外证人立法、单位的作证方式及证言效力上看,证人应仅限于自然人,应逐渐废弃单位的证言主体资格.

| Abstract: | According to our country's witness rules, natural person or body can be witness in court. After investigation of the nature of witness, the witness statues of foreign countries, the way of presenting evidence and legal force of witness, it is concluded that it is natural person that can be witness and the body's capacity of witness should be abolished. |
