有机农业: 法律规制与政策扶持

摘    要:有机农业价值的双重性以及有机农产品外观的不易辨识性决定了对该产业进行立法非常必要。在有机农业发展的初级阶段,应当主要由公权性机构担任认证机构,并且应当采取以结果监管为主、全程监管为辅的监管模式。待有机农业发展到高级阶段,则应当主要由非公权性机构担任认证机构,并且应当采取以全程监管为主、结果监管为辅的监管模式。对有机农业进行政策扶持非常必要,我国应当通过财政补贴和市场推广等方式对其进行扶持。

Abstract:The legislation of organic agriculture is very necessary because of the double value of organic agriculture and the difficulty to identify the organic products.On the primary stage of organic agriculture,we should choose governmental institutions as certification institutions,and we should employ the supervision mode which put emphasis on the consequence rather than the process.While on the senior stage,we should choose non-governmental institutions as certification institutions and should employ the supervision mode which put emphasis on the process rather than the consequence.It is very necessary for us to sustain organic agriculture,and we should sustain the estate by means of financial subside and market extension.
