典型国际海洋划界案例相似性研究

简要研究了2012年国际法院最新判例——尼加拉瓜诉哥伦比亚领土和海洋划界案,总结了本案中国际法院关于海上争议岛屿主权判定把握的要点,国际法院受理该案件的理由和受理的内容。国际法院用三阶段方法确立尼加拉瓜和哥伦比亚海上边界。提出了维护我国海洋权益必须研究国际最新判例相似性的建议。

Research on a Typical Case of International Maritime Delimitation

Maritime delimitation is the most dynamic issue in the area of the international law of the sea. This paper concisely studies the latest case judged by the International Court of Justice （ICJ） in 2012 territorial and maritime dispute （Nicaragua v. Columbia）. This paper summarizes the key points adopted by ICJ to judge the sovereignty over disputed islands at sea, the admissibility of this case discussed by ICJ and the content of this admissible case. ICJ followed the three-stage methodology to establish the maritime boundaries between Nicaragua and Colombia. This paper recommends that we should study the similarity of the latest cases in order to safeguard the marine rights and interests of our country.
