| 摘 要： | 修订后的《律师法》将于2008年6月1日开始实施，新《律师法》对原有法律做了较大的修订，最引人注目的是新《律师法》赋予律师在刑事诉讼中更大的权利，较原《律师法》及现行《刑事诉讼法》都有质的突破，这在我国社会主义法制建设史上具有重要的里程碑意义，但律师作为辩护人权利的扩张，便意味着司法机关的公权力受到更为现实的监督和制约，如何在切实保障律师权利的同时从容应对律师深入参与后的刑事诉讼，是司法机关在新《律师法》实施后所面临的新的现实的挑战，也是现阶段应当着重研究的重要课题，

| Abstract: | The rivised Law of Lawers will take effect on June 1,2008.Much revision has been made in the new Law of Lawers over the old one.The most obvious point is that lawers are endowed with greater rights in criminal suit.It has made a substantial breakthrough as comparing with the original Law of Lawers and the present Law of Crimial Suit.This is a milestone in the history of our socialist legal system construction,but as defenders,the expansion of the lawers' rights means that the public power of the.judicial organs will get more practical supervision and restraint.While protecting lawers' rights,how can they calmly deal with criminal suits after lawers' participation, this is a a new and realistic challenge facing the judicial organs after the new Law of Lowers is carried out and an important research subject for us at the current stage. |
