| 摘 要： | 文章阐述了非法证据排除规则的一般做法、“毒树之果”理论以及我国应如何对待非法证据排除规则,最后论述了一个与非法证据排除规则有关的问题,即警察使用“侦查陷阱”获得的证据是否应当排除。

| Abstract: | This paper explores the general stipulations on the rule of removing illegal ecience and the theory about "fruits of the poisonous tree" as well as how to approach the rule of removing illegal evidence in our country. At last the article introduces a issue relawant to the rule of removing illegal evidence, i. e. whether or not the proof should be removed when it is got by "entrapment". |
