OLED公司专利许可与诉讼情况浅析

The preliminary analysis on patent license and litigation situation of OLED corporations

This paper introduced in detail the authorization, cross-licensing and litigation situation among OLED corporations, and provided reference for Chinese related corporations to break intellectual property barriers during the international process. The major OLED patent portfolios are held by Kodak （small molecules）, Cambridge Display Technology CDT （polymer）, Universal Display Corporation UDC （phosphorescence, etc.） and so on. AU Optronics vs Samsung Electronics, Philips vs Osram, Idemitsu Kosan vs LG Display, Idemitsu Kosan vs Sony, Idemitsu Kosan vs TDK have signed patent cross-licensing agreement on OLED technology. There also appeared patent litigation in the field of OLED. As the OLED industry matures, OLED patent disputes will continue to increase. If Chinese corporations are willing to join in the OLED ＂war＂, they not only need to pay attention to the patent layout as counters to proceed patent cross-license action with foreign magnate, but also actively to strive for certain basic patent license which can not be bypassed to reduce the risk of being sued.
