| 摘 要： | 学界通说认为,中国古代法律是以刑为主,诸法合体。中国的法制史其实就是一部刑法史,中国古代的法律思想主要就是刑法思想。中国古代,以"德主刑辅"为核心的儒家法治思想,对中国古代刑法的发展产生了深远的影响。文章论述了儒家刑法思想的基本内容,指出儒家的伦理道德很多被转化为刑法规范,对立法、司法以及守法产生了极为深刻的影响。
