劳动者预告辞职制度法律问题研究

摘    要:随着劳动者维权意识的增强,劳动者的弱势地位有所改变,劳动合同法过于倾向保护劳动者利益的立法宗旨,与现实操作层面上的矛盾日益显现。其中劳动者预告辞职制度立法的现时设计存在缺陷,导致用人单位合法权益难以得到公平保障。应借鉴国外相关立法规定,对我国劳动立法进行深入研究与修改。

Research of the Legal System of Worker’s Notification for Labor Contract Termination

Abstract:As workers' consciousness of safeguarding their legal rights has been strengthened rapidly and their inferior position has been changed,the contradiction between the legislative purpose of Labor Contract Law,which is too inclined to protect the interests of workers,and the operational reality is exposed.Hereinto,the social contradictions caused by the system of worker's notification for labor contract termination are becaming increasingly prominent,so the further study and amendment shall be made as regards such legal provisions by referring to similer laws abroad.
