德国"双轨制"法学教育改革的启示

德国“双轨制”法学教育,实行宽进严出,不作时间上的限制,并且具有制度和法律保障,注重实践性,因此对高质量的法学人才的培养大有裨益。它的培养目标从偏重培养法官检察官的“统一法律人”,向注重包括律师职业和律师实务在内的“法律职业专业人才”方向转变;从培养“爷爷法律人”的8-9年学制向6-7年缩减;改革国家考试制度,充分发挥大学法律系教学积极性,在各大学法律系开展提高教学质量的良性竞争:这些经验是中国法学教育与改革应当借鉴的。

Enlightenment from the Reformation of "Dual System" on Law Education in Germany

Under the "dual system",the law education in Germany has a lot of benefits.Universities pay more attention on practicality and enrollment but exigent graduation comparatively released in the period of learning,with the safeguard of institutions and laws.Connecting with the present situation and reformation of law education in China,we can use the experiences of "dual system" for reference in the following aspects.Firstly,the object of education should change from "general Templar" which focuses on judges and procurators to "career specialists" which includes attorneys and counselors;secondly,the length of education should be reduced from eight-to-nine years to six-to-seven years;thirdly,the reformation of national examination system of law carried out;last but not the least,it stimulates the enthusiasm of law departments in universities by benign competition of teaching quality.
