法哲学视野中的体育法概念

分析了我国体育法学研究中5种关于体育法概念的主要观点及其问题所在,并从法哲学各种流派的诸多视角对法与法律、法律与国家、国家法与"活法"以及法律的本质属性等法学的基本问题进行了归纳分析.研究认为,法与法律在语词和含义上均不相同,应当区别开来;法早于国家的出现,用国家制定与认可作为法律成立与否的前提有失偏颇;现代社会的法律体系是多元的而不是一元的,其中,既有国家法也有"活法";阶级性只是阶级社会中部分法律的特征,而不是法律的本质属性.在此基础上,分析了体育法概念的内涵、外延及体育法学的主要研究对象.

Study on Definitions of Sports Laws within Sight of the Philosophy of Rights
