| 摘 要： | 目的 :探讨在司法鉴定如何确定病理性激情作案。方法 :根据我院司法鉴定中 2 0例激情凶杀案资料统计分析。结果 :病理性激情刺激强度与剧烈的刺激反应不相匹配。且意识障碍程度重 ,均有后继性遗忘 ,作案动机顿起 ,都有促发因素且与作案的指向性密切相关 ,其患有原发病显著高于生理性激情作案者。结论 :意识障碍程度是鉴定病理性激情的关键 ,而意识障碍可借助于发作后体力与精神衰竭、后继性遗忘以资鉴别。

| Abstract: | Objective To analyze how to determine pathological affect murder in judicial expertise.Method To make statistical analysis according to the material of 20 cases of affect murder from our center.Result For pathological affect murderer,the intensity of stimulus doesn′t accord with the fierce reaction.Their consciousness disorder is great,accompanied with residual amnesia.Their abrupt starting of the motivation to murder has its promoting factor,which is closed related to the directionality crime.the percentage of pathological affect murder with prime disease is much higher than that of physiological affect murder.Conclusion The key to determine pathological affect is the degree of consciousness disorder,which can be determined by the exhaustion of mind and physical force and by residual amnesia. |
