加大科技含量强化法制管理确保铁路平交道口安全

通过对我国铁路平交道口交通事故现状及事故原因分析，在借鉴以往研究成果的基础上。提出了通过加大道口安全的科技含量，强化法制管理，确保铁路平交道口安全的观点。通过立法，确定铁路平交道口的铁路生产性和社会公益性的双重属性，从而确定铁路和地方在道口建设、改造、维护等各个方面的法律责任，为道口建设筹集资金和安全维护创造良好的环境；同时，强化道口规范的实施，依法约束车辆驾驶人员和行人的不安全行为。

Enhance the Scientific and Technological Content, Strengthen Legal System Management, Guarantee the Safety of Railway Grade Crossing

On the basis of drawing lessons from past research results, this paper analyzes current traffic accident situation and accident reason of railway grade crossing in our country, and then puts forward the view of guaranteeing the security of railway grade crossing ,by strengthening the scientific and technological content in the railway grade crossing, and strengthening legal system management. Through legislating, we confirm the double attributes of railway grade crossing which are the railway productive and public beneficial, thus confirm the legal liability of railway and region in building, transforming and safeguarding the grade crossing, and then create the good environment for building the grade crossing such as raising fund and safeguarding security; Meanwhile, strengthening the normal implementation of road junction, and restraining unsafe behaviors of driver and pedestrian, according to the law.
