科学发展的公法回应——通过公法均衡化推动中国社会发展科学化

公法影响社会发展态势,不仅体现为公法能够通过建构和规范发展关系影响发展模式选择,更在于公法应以理顺公、私益关系的方式解决发展中的效率与公平矛盾。要通过在最优配置社会资源的基础上公平分配社会财富的方式实现社会福利的最大化,就必须依靠平衡公法保障社会科学发展,就必须将失衡公法与不科学发展之间的恶性循环改写为平衡公法与科学发展之间的良性互动。当下,我们的一个重要任务就是通过公法的均衡化来推动中国社会发展的科学化。

Public Law's Response to Scientific Development

The paper points out that the public law influences the situation of social development, not only in that public law can influence the choice of social development models through constructing and normalizing development relations, but in that public law should settle the contradiction between efficiency and equality by rationalizing the relationships between public and private interests. The article demonstrates that, in order to maximize social welfare by distributing social wealth equally on the basis of optimal configuration of social resources, we must rely on balanced public law for protecting scientific social development and transforming the vicious circle between imbalanced public law and unscientific development into fine interactions between balanced public law and scientific development. At present, an important task is to achieve scientific social development by equilibrizing public law.
