正义感、移情与司法裁判

司法裁判并非是一项纯粹理性的事业,属于情感范畴的正义感构成了法官裁判的重要视角,在裁判工作中发挥着认知和指引的关键性作用.从情感理论上来说,正义感的形成主要赖于移情这一情感现象,而移情的展开需以无偏私性和信息充分为必要条件,这样才可能导向正义的个案裁判.不过,正义感的运用并非不受理性的约束,它只是为裁判提供了一种行动计划和倾向,法官仍然要诉诸于以合法性思维为框架的法律理性论证.因此,司法裁判的作出最终依赖于正义感与法律理性论证之间的良性互动.

Sense of Justice,Empathy and Judicial Adjudication

Judicial adjudication is not a cause of pure reason.The sense of justice which belongs to the category of emotion is an important perspective of judge`s adjudication and plays a critical role of cognition and guidance in the referee work.From the perspective of emotion theory, the formation of sense of justice mainly depends on the emotional phenomenon of empathy, while the application of empathy is based on unbiased and sufficient information as a necessary condition, only in this way could the appropriate of adjudication of individual cases be reached.However the application of sense of justice is not restricted by reason, it provides a kind of action plan and tendency for the judgment, the judge still has to resort to legal reasoning in the framework of legal thinking.Therefore, the final judgment of justice depends on the positive interaction between sense of justice and legal reasoning.
