| 摘 要： | 盖尤斯《法学阶梯》创立了＂人法—物法—诉讼法＂的民法体系模式。人文主义法学家将其改造为＂人法—对物权法—债法＂的新三分式民法体系。与传统的法学阶梯式民法体系相比,现代法学阶梯式民法体系已经有了很大的改观,继承法逐渐从＂物法＂中分离出来,在某些方面正在与潘得克吞式民法体系走向融合。

| Abstract: | In Gaius' Institutes,the system of laws on persona-res-actio were created,while the humanism jurists reformed such system into a new system of laws on persona-ius in re-obligatio.Compared with traditional system,the modern system has a great change,separating succession law from laws on res,and to some extent,integrating with the Pandecten civil law system. |
