| 摘 要： | 劳务派遣是我国劳动力市场发育过程中出现的一种新型就业服务方式和企业用工制度.2008年1月1日起实施的<劳动合同法>首次以法律形式明确劳务派遣三方法律关系.对保护被派遣劳动者的合法权益具有重要意义.但由于对劳务派遣制度背后的理论研究不够透彻,本法在权利义务划分、责任承担及权益保护方面还存在立法缺憾.
