| 摘 要： | 民事责任能力是法律关系主体因违法或没有履行法定义务而承担否定性法律后果的能力.民事责任能力是主体能够承民事责任的前提与基础,而非具体的民事责任.民事责任能力既体现了一定的人文伦理性,同时也是法律抽象技术性的产物,它是私权关系的体现,贯穿于民事法律制度始终,是主体不可转让也不能放弃的能力.
