| 摘 要： | 《鹿特丹规则》的先进性表现为：平衡利益,寻求统一,顺应时代,促进发展;其不足表现为：规则内容庞大,条款交织复杂;创新制度有不完善之处;有些制度的可操作性有待实践检验。文章还就公约签署,参加公约的时机以及修改《中华人民共和国海商法》等问题提出建议。

| Abstract: | The article evaluates the Rotterdam Rules, summarizes the advantages and blemishes. The advantages are as follows： balance the interests, seek for unity, along with the times and promotion of development. The blemishes are as follows： the content is huge and clauses are complex and intertwined; there are some imperfections in the innovated systems; the feasibility of some of them remain to be examined. The article also brings up some proposals for signing the convention and the opportunity of acceding in the convention and amending Maritime Code of the People＇ s Republic of China. |
