中国特色社会主义人权理论体系论纲

随着改革开放的深入,中国的人权事业取得了巨大的进展,人权的理论研究逐渐成熟,梳理、提炼中国特色社会主义人权理论体系已为可能。中国特色社会主义人权理论体系的基础性要素,包括人权的概念、属性、类别、实现机制和社会条件等。中国特色社会主义人权理论,既承认人权是人类的共同理想和价值准则,是人之为人不可剥夺的权利,尊重和保障人权是每个主权国家的义务,需要通过国内的立法、行政和司法机制予以落实,需要加强人权国际合作以促进其实现,也承认人权发展的阶段性和历史文化传统对人权实现方式的影响,反对人权国际合作中的霸权主义倾向。

Outline of the System of Socialist Human Rights Theory with Chinese Characteristics

With the deepening of the reform and opening up, China has made great achievements in the development of the human rights cause and, with the gradual maturing of the research on human rights theory, now the time has ripe for China to construct a system of socialist human rights theory with Chinese characteristics. The fundament elements of such a system include the concept, the attributes, the category, the mechanism for the realization and the social conditions of human rights. The socialist system of human rights theory recognizes that human rights are the common aspiration and value standard of all mankind and the inalienable rights of every individual as human being, that it is the obligation of every sovereign state to respect and protect human rights, that human rights should be implemented through domestic legislative, administrative and judicial mechanisms and that it is necessary to strengthen the international cooperation in the field of human rights in order to promote the realization of human rights. On the other hand, it also recognizes the historical stages of the development of human rights and the influence of history, culture and tradition on the way of realization of human rights and opposes hegemonism in the international cooperation in the field of human rights.
