行政程序价值体系的法理论证

行政程序是现代行政法的核心部分,其价值体系的合理与否直接关系到程序制度的法律效果的实现。法律规范的应用要依赖法律原则的指导,行政程序法制价值体系的合理,离不开法律文本中对法律原则的科学设置和意义权衡。不同行政领域中的程序价值体系对法律原则之间的效力位阶的安排不同。立法者对法律原则的功能未有充分认识,实践中未经考虑行政领域的特性而在法律文本中设置的法律原则之间存在内在冲突,造成行政程序价值体系的混乱。我国未来行政程序法制的建设必须认真对待法律原则的合理设置和相互协调。
