| 摘 要： | 犯罪构成作为划分罪与非罪的根本标准,适用于一切犯罪行为。共同犯罪作为犯罪的一种特殊形态,在犯罪构成上具有自己的特性,表现为修正的犯罪构成。共同犯罪理论只有以犯罪构成理论为基础,以共同犯罪的修正的犯罪构成,来认识和理解共同犯罪,才能为共犯的定罪量刑提供科学根据。

| Abstract: | Constitution of a crime as the criterion for distinguishing crimes from non-crimes can be applicable to all kinds of criminal behaviors.Joint commission of a crime as a special crime has its own characteristics in its constitution and appears as an amended constitution of a crime.The theory of joint commission of a crime shall be based on the theory of constitution of a crime in order to fully understand joint commission of a crime and offer scientific support for the punishment of joint commission of a crime. |
