| 摘 要： | 视婚姻为合同的思想由来已久且很有价值,但这一价值迄今未得到充分的重视和发挥.用合同的法理考察透视婚姻的效力状态,我们看到,《婚姻法》规定了婚姻的有效、无效和可撤销,但缺乏对于婚姻效力待定的规定;同时.还可以发现,在婚姻的无效和可撤销的具体适用条件上,《婚姻法》的规定有必要进一步完善.

According to this thought,we can see that the family law has not talked about the hanging of marriage legal force,and that the family law is different from contract idea in the conditions of invalid marriage and revocable marriage. |
