美国州检察长监管慈善资产的法律机制探究

美国州检察长是代表公共利益和保护慈善资产的重要部门,它已形成了慈善组织董事的解任机制、慈善资产流转的控制机制、慈善法人组织解散的监督机制以及诉讼和派生诉讼等较为全面的监管机制。当前,中国共产党第十八届四中全会提出了建立法治国家、建构检察机关公益诉讼制度的任务,我国可以借鉴美国这一制度,赋予我国检察机关相应的诉权、调查权和重大事项干预权等权能,以保障慈善资产的安全运行和促进慈善公益事业的健康发展。

Study on Legal Mechanism of Charity Assets Supervision by U.S.Attorney General

The U.S.Attorney General is one of the most significant departments to represent public interest and to protect charity assets , and it has developed a comprehensive regulatory structure including dismissal mechanism of charity organization director , control mechanism of charity assets flow , supervisory mechanism of charity corpo-rate organization disbandment , litigation and derivative suit .At present , since the fourth plenary sessions of the Eighteenth CPC Central Committee has set the goals of establishing a nation of laws and building a lawsuit system of public interest , we can learn from the system run in the United States to entrust our procuratorial organs with litiga-tion right, investigation right and intervention right in major issues , which is believed to protect the operation of Chinese charity assets and to promote a healthy development of Chinese charities .
