高校授予多学士学位的合法性分析

“双学位”是目前存在于许多高校实践中，却未在中央政策文件中有明确规定的教育形式。各地对其都有所探索，但部分地区也出现了对“双学位”效力不予承认的现象，损害了学位的权威性。文章从行政法的视角，将高校授予学位的权力作为一种行政权进行探讨，比较“双学位”的学位概念与一般学位概念，从学位自身特点、学位授予行为的性质、学位申请行为的性质三个方面，论证双学位之“学位”的合法性，找出现有问题原因，并为解决学位的社会承认问题提供合理的政策建议，指出应当最终推动学位制度改革，将国家学位制度向大学学位制度演变，提高学位授予的自主性和权威性。

Legitimacy Analysis for University Awarding Multi -Bachelor -Degrees

Double Degree exists in many universities, but it has not been regulated by the Central government. With the exploration, there are also some areas which don＇ t admit it, being harmful to the authority of degree system. This thesis stands on a view of administration law and discusses the power of university awarding degree as an executive power. It compares differences of degrees between Double Degree and the general degree and analyzes the validity of Double Degree in the view of its characters, characters of awarding degrees and characters of applying degrees. Also it tries to find the problems existing in the practice and the solution , indicating that the final solution is to promote the national degree system evolving into the university degree system.
