| 摘 要： | 传统的刑罚目的理论正在面临着愈来愈多的挑战。刑罚目的可作如下划分,即:以刑罚作为刑法的下位概念为基础,在横向层次上,将刑罚目的划分为主要目的(惩罚犯罪)和次要目的(预防犯罪)两个层次,此为狭义的刑罚目的之理性建构;在纵向层次上,将刑罚目的划分为第一层次惩罚犯罪与预防犯罪(直接目的)与第二层次保护法益(根本目的)两个存在递进深入关系的层次,此为广义的刑罚目的之理性建构。
