| 摘 要： | 网络环境使得著作权保护得以扩张。网络环境下著作权保护存在两种范式：市场范式和接近范式,基于该两种范式的不同认识,存在不同的网络环境下著作权的保护模式。而网络环境下,著作权的目的仍然是著作权人与公共利益的平衡,基于该利益平衡的需要,对网络著作权需要给予适当限制。
