弱势群体司法制度保护的完善——强制代理制度在行政诉讼中的植入

分析了现行司法制度特别是行政诉讼制度在保护弱势群体上，存在的缺乏强制保护机制和操作有效性的问题。指出了要解决弱势群体在行政诉讼程序中得不到实质保护的问题，就必须在行政诉讼制度中植入强制代理制度，对弱势群体施以必要的援助和保护；要解决法律援助援而不助的问题，就必须配合强制辩护制度，使之对弱势群体的帮助落到实处。

Improve the Protection of the Judicial System of Vulnerable Groups ---Mandatory Defense System Implantation in the Administrative Proceedings

In the protection of vulnerable groups, there are issues that lacking of force protection and operational effectiveness from the existing judicial system of administrative litigation system. We must solve the issues that the disadvantaged groups in the administrative proceedings can＇ t acquire real protection. We should implant the mandatory defense system in the administrative litigation system and impose the neces- sary assistance and protection of the vulnerable groups. In order to solve the problem of the ineffective le- gal assistance, we must coordinate the mandatory defense system, so that the help of the vulnerable groups can be effective. Therefore, it＇ s necessary to further explore and innovate the implantation of mandatory defense system in the administrative proceeding.
