抢劫赌资行为之定性研究

针对我国抢劫赌资发案率激增现象,最高院出台了相关的司法解释。但这一司法解释没有对现实中可能会遇到的具体情形进行分类概括,导致实际运作中产生许多问题。有鉴于此,本文从对赌资的定性入手,对刑法和相关司法解释中关于＂抢劫赌资＂的规定进行进一步阐释,弥补了最高院的司法解释存在的疏漏,使司法实践对其的认定更能体现刑法的精神。

Qualitative Analysis on the Act of Gambling Money Robbery

In response to the sharp increase in the incidence of gambling money robbery,the Supreme People＇s Court released relevant judicial interpretations.However,these judicial interpretations have not classified specific circumstances that we may encounter in reality,and they cause many problems in actual operation.In view of this,starting from the qualitative analysis on the gambling money,this article further explains provisions about＂gambling money robbery＂in the criminal law and relevant judicial interpretations.This article remedies defects that exist in judicial interpretations,and makes these judicial interpretations reveal criminal law spirit more suitably.
