| 摘 要： | 英美刑法严格责任突破了"无罪过即无犯罪"的传统刑法原则,其适用的犯罪或因其犯罪意图的难以证明,或因其侵害的社会法益特殊而需要特殊保护。严格责任在实体法上体现为对那些所从事的活动与公众利益密切相关的人提出比一般人更严格的责任要求和注意义务,在程序上则表现在严格的"举证责任"上。

| Abstract: | The emergence of the strict liability of Anglo-American criminal law broke the traditional criminal principle of "non reu nisi mens sit rea".The strict liability is only applicable of the crimes whose interests of which the criminal law intends to safeguard are special,and whose mens rea are difficult to prove.Rigorous "duty of care" is manifested in substance and strict "burden of proof "is displayed in procedure. |
