| 摘 要： | 在合同法中建立起违约精神损害赔偿的相关制度,对违约精神损害予以赔偿的合同类型加以界定,同时对精神损害的发生及严重程度的判断提供标准,另外,对损害赔偿的数额的确定提供指导原则及参考依据,以保障合同当事人的合法权益。

| Abstract: | To guarantee the legal rights and interests of the parties concerned,it is necessary to establish related system of mental compensation for the breach of contract in contract legislation,define the contract category which specify mental compensation for breaching the contract,provide judgment criteria for the occurrence and the degree of mental damage,and provide guiding principles and referential bases for the determination of the amount of compensation. |
