| 摘 要： | 中国的判例制度与判例法有本质的区别,它有以下几个方面的功能,即法律的起源,法的生长点,解释、说明制定法,解决当前司法标准的不统一,它是实现司法公正的重要手段,它有助于法官正确地适用法律,限制法官的自由裁量权及有助于造就一支高素质的法官队伍。

| Abstract: | Legal precedent,namely"precedent on the judgement",and it is sources of law of legal precedent.Legal precedent system and legal precedent law of China have essential difference,it have following several function of,namely the origin of the law,growing point of the law,explain,prove the law of making,remedy and make the deficiency of France,solve the present and judicial and standard disunion,realize the important means of the justice,help judge applicable law correct,restrain freedom right of cutting out etc.of judge from and is it buing up one highquality judge from and is it bring up one highquality judge team to contribute to. |
