| 摘 要： | 罚金是我国新刑法规定的一种刑罚方式,但修订后的刑法在罚金刑的数额、执行等方面规定得过于原则,带来了审判实践中操作困难、罚金数额混乱、空判严重等问题。如何使罚金刑得到切实地执行,需要我们进一步改进制度：一是明确执行主体,加强法院内部审执机关的联系,建立严格明晰的档案制度,规范执行程序。二是完善罚金刑分期执行制度,建立罚金刑执行与减刑假释相挂钩的方法。三是实行执行保障和救济措施,建立异地委托执行制度。

| Abstract: | Forfeit is a penalty stipulated in the new penal code in our country, yet, as the amount and execution of forfeit stipulated are too principled, it＇ s difficult to carry it out, and the amount and the use of the forfeit are sometimes confused. It＇s necessary to reform the system： 1. to make clear the executive body, forming a closer relationship between judgment and execution and a strict and clear file system; 2. to improve the system of execution by stages, setting up the way of forfeit execution connected with reducing penalty and releasing on parole; 3. to take the measures of guarantee of execution and relief, and set up the system of entrust execution in strange land. |
