论伦理亲情与法律

伦理亲情在传统社会主要有亲属之爱、别和从 3层含义 ,在现代社会主要是指亲属之爱。在传统法中呈现法律亲情化趋势 ,现代社会伦理亲情在法律上仍有其存在的合理性。从整体来说 ,中国现代法出现了亲情的法律化趋势。但现在法律中存在忽视亲情伦理的缺陷 ,有必要将更多的亲情规范上升为法律规范。

A Discussion on Ethical Kindred and Law

In traditional society ethical kindred includes three layers: love, discrimination and subordination among kindred. In modern society, however, ethical kindred mainly means love among kindred. The legal kindred trend appeared in the traditional law, and the existence of ethical kindred in modern society has rationality in law. But there is a defect of ignoring kindred ethics in law now. It is necessary to raise more kindred ethics to the rules of law.
