法律移植的理论及原因评析

法律移植是不同文明之间的法律制度互相借鉴与取舍的过程,只要国家或民族间彼此发生了关系,都将会造成文化上的冲突与融合的过程.自有国家以来,几乎任何形式的法律文化都避免不了法律之间的移植问题,所以说法律作为人类文明的共同成果,在国家和民族间创造性地移植和借鉴是历史的必然,更是国际文化交流背景下所产生的一种必然现象.我国目前正在努力建设社会主义法治国家,移植或吸收其他国家和民族的法律无疑具有重要意义.本文通过对法律移植的理论评析,着重论述了进行法律移植的充分理由.

On the Theory and the Cause of the Transplant of the Law

At present, our country is striving to establish a socialist country ruled by the fully legal system. Therefore, without any doubt, it is significant to transplant or absorb the law from other countries and areas. The thesis hits the point that the transplant of the law is necessary by the analysis of its theory.
