理论与实践互动法在商法教学中的运用

传统课堂“填鸭式”与“案例教学法”教学所培养出来的法学本科生难以适应现代商业社会对商法人才的需要,“诊所式”法学教学亦难以达到本科生对系统商法理论学习的诉求。而“理论与实践融合互动”教学模式比较受学生的欢迎,对培养具有扎实商法理论功底和实践技能的商法人才更有潜力。运用该教学模式的关键是针对商法不同教学模块的特点设计教学方案,对学生难以理解和实践操作性强的教学模块采取商事部门观摩或操作,回到课堂后通过学生交流,经典案例情景角色分担式的模拟法庭式辩论,再辅之以多媒体实践场景的再现,让学生自己发现问题、分析问题,最终解决问题。

The Application of the Theory and Practice Interactive Method in the Teaching of Business Law

The undergraduates trained by the traditional ＂duck-feeding teaching＂ and ＂case teaching methods＂ cannot satisfy the need for business law talents in modern commercial society. ＂Clinical teaching method＂ is still difficult to reach the requirements of undergraduates for systematic learning of the theoretical knowledge. But ＂the theory and practice interactive teaching＂ mode is popular among students. It is a more potential method to train the business talents with strong theoretical knowledge and practical skills. The key of using this teaching mode is to design the teaching plan according to the different teaching modules of business law. For some modules which are hard to understand and need practical operating skill, students should be provided with the opportunities to observe or operate on their own. After coming back to the classrooms, students may exchange ideas with others, imitate the court debate of some classic eases by taking the roles in the situation. With the recurrence of the situation by using multi-media equipment, we will let students discover, analyze and solve the problems.
