| 摘 要： | 中国古代司法判决中的修辞不是法官故意炫耀的文学技巧,而是作出令人信服的论证和寻求合理性判决的方法。以修辞作为司法判决的说理方法是法官的理性选择,修辞方法在实现司法功能时并未让法律陷入不确定性之中。法律修辞是法律人在充满价值冲突的具体案件中作出合理法律判断的重要法律方法,在价值多元的现代社会,蕴含着人文主义的修辞方法应当被重新记起。

| Abstract: | Rather than a literary technique used by the Chinese ancient judges,rhetoric is a persuading method of argumentation to achieve a reasonable decision.The use of rhetoric in judicial process is a rational choice of the judges,because it achieves the function of the judicature without destroying the certainty of law.In the multivalue modern society,legal rhetoric,an important method to achieve a reasonable legal decision in the legal practice of conflicted values,should be reused because of the humanism value it contains. |
