| 摘 要： | 结合各国装备采购法律理论及具体法律规定 ,分析了装备采购主体在装备采购合同中所具有的合同履行指挥权、单方面变更合同权、单方面解除合同权和对承包商制裁权等特殊权利的内涵、产生基础和适用条件以及对承包商的利益平衡措施 ,对目前寻求我军装备采购制度改革途径具有一定的指导意义

| Abstract: | Combining with the equipment\|purchasing lawful theories and specific lawful stipulates of different countries, this paper analyzes the connotation, foundation and applicable condition of the contract\|performing command right, unilateral contract\|changing right, unilateral contract\|relieving right and contract\|punishing right which are taken on by the equipment\|purchasing subject in the equipment\|purchasing contract, and benefit\|balance measures for the contractors. This research has instructive meaning for pursuing innovation approach of the equipment\|purchasing system at present. |
