善意取得制度新论

善意取得制度是一项古老的民法制度,也是民法的基本制度之一,其主旨在于保护交易安全、稳定经济秩序。善意取得制度起源于日耳曼法中的“以手护手”原则,现已得到各国民法的承认。善意取得的构成要件包括:受让人取得财产时出于善意;转让人为无权处分财产的人;受让人必须通过有效的法律行为而取得财产;善意取得的财产是法律允许流转的财产;转让人已经将标的物交付给受让人。

A New Theory of the Bona Fide Gaining System

Bona fide gaining is an ancient and also a basic civil law system.It purports to protect the safety of transactions and stabilize economic order.Derived from the principle of "hand muss hand wahren" in Germanic law,bona fide gaining has been successfully incorporated into civil laws of all the countries.The requirements of bona fide gaining include: the assignee gains the property in good faith;the assigner is one that has no rights to dispose of the property;the assignee must take a legitimate act to acquire the property;the property acquired in good faith is one that is transferable under the existing laws;and the assigner has already delivered the subject matter to the assignee.
