摘 要: | 房屋租赁权是一种债权的物权化还是一种债权或者物权,历来争论很大,通过正反论证、类比论证、利益衡量的方法,对将房屋租赁权定位为债权的物权化这一学说进行质疑,可以认为房屋租赁权是用益物权。

Abstract: | It has been argued for a long time that the Leasehold of House is Creditor's Right,Real Right or Creditor's Right with the character of Real Right.In this paper,the author will,by way of arguing pro and con,analogous argumentation and benefit balance,put forward that Leasehold of House is a Usufructuary Right on the basis of criticizing the theory that Leasehold of House is Creditor's Right with the character of Real Right. |
